(d)
An application requesting the rezoning of an area of land from one type of zone to
another shall be signed by the owner or any one of the owners, or the authorized agent
of one or more of the owners of the property which is the subject of the application.
Unless the Council is of the opinion that there is valid new evidence or change in
conditions, where an application under this section has been refused by the Council, no
further application may be considered by Council for one year if such application:
(i)
in the case of rezoning, is in respect of the same area of land with which the
original application was concerned; or
(ii)
not being in relation to rezoning is similar to the original application.
(e)
(i)
The Committee shall allow a person who has applied for the rezoning of land an
opportunity to be heard before giving its views to the Council,
(ii)
The Committee may also allow a person other than the applicant for the
rezoning who wishes to support or object to the proposed rezoning to be heard
before giving its views to the Council.
(f)
Notwithstanding the foregoing, staff, Planning Advisory Committee or Common Council
may initiate amendments to this By-Law, or Common Council may authorize the holder
of an option or a purchase and sales agreement for City-owned land to apply for an
amendment to this By-Law.
Exemptions
(4)
The following developments, although still required to meet the requirements, if any, of this
By-law, shall be exempt from the provisions of Section 81 of the Community Planning Act:
(a)
any alteration to the interior of a building or structure which does not involve:
-
a change of use,
-
an increase in the number of dwelling units,
-
a structural alteration.
(b)
any alteration to the exterior of a building or structure:
-
which does not involve an increase in the size or exterior dimensions,
-
involving any of those matters exempt in Section 820(12), or
-
involving a sign exempted by the provisions of Section 840(11).
Calculation of Numerical Requirements
(5)
Except as otherwise provided in this By-law, where the calculation of numerical requirement
under this By-law results in a fraction:
(a)
a fraction less than one-half shall not be taken into consideration; and
(b)
a fraction of one-half or more shall require the next higher full number.
